- Limited Warranty.
- THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.
- Backcountry warrants to Buyer that for a period of three month from the Delivery Date of the Container (“Warranty Period”), all materials manufactured by Backcountry and contained in such Container will materially conform to the specifications set forth ON THE WEBSITE AS MODIFIED ON EXIBIT A and will be free from material defects in material and workmanship.
- WE LIMIT THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE WARRANTY PERIOD.
- SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
- THIS LIMITED WARRANTY CAN ALSO BE FOUND AT WWW.BACKCOUNTRYCONTAINERS.COM/WARRANTY AND IN THE DOCUMENTATION WE PROVIDE WITH THE PRODUCTS.
- This Limited Warranty does not cover damages due to: improper use; failure to follow the instructions or to perform any preventative maintenance; modifications; combination or use with any products, materials, processes, systems, or other matter not provided or authorized in writing by Backcountry; unauthorized repair; normal wear and tear; or external causes such as natural disasters, accidents, abuse, or other actions beyond Backcountry’s reasonable control. Products manufactured by a third party (“Third-Party Product”) may constitute, contain, be contained in, incorporated into, attached to, or packaged together with, the Container. Third-Party Products are not covered by the Limited Warranty. Further, the foundation, including any materials therein, or other materials or connections at Buyer’s Location are not covered by the Limited Warranty.
- With respect to any such Container during the Warranty Period, Backcountry shall, in its sole discretion, either: (i) repair or replace such Container (or the defective part) or (ii) credit or refund the price of such Container; provided that, Buyer shall, at Backcountry’s expense, return such Container to Backcountry.
- To obtain warranty service, you must call 713-962-4165 or email our Customer Service Department at accounting@backcountrycontainers.com during the Warranty Period to obtain a warranty claim number.
- Further, you acknowledge that the Standard Container is not a HUD-code manufactured home or a mobile home and Backcountry is not a licensed manufacture thereof or a general contractor.
